Retd Judges Appeal Over Same Sex Marriage; Will Break Indian Society

Several former judges have come forward putting how same- sex marriage is worsening for the social fabric. And in Bharatiya context, this Woke culture is attacking the ethos and natural order of life.

What Is The Issue?

The issue of same-sex marriage has been a contentious one in India. While homosexuality was decriminalized by the Supreme Court in 2018, same-sex marriage remains illegal under Indian law. The LGBTQ+ community has been pushing for the legalization of same-sex marriage in India, but their efforts have met with resistance from some sections of society.

The judges noted that while the Supreme Court had decriminalized homosexuality, it had specifically stated that it was not addressing the issue of same-sex marriage.

They argued that this was a clear indication that the matter should be left to Parliament.

Former Judges’ Appeal

In a joint statement, 21 former judges including Justice S N Jha, M M Kumar and S N Dhingra have urged people to understand the issue of same- sex marriage very keenly before coming to any conclusion.

According to the letter, “Therefore, owing to its devastating impact on children, family, and society, mindless attempts to ape the practices of West in India, especially by legalising same-sex marriage, would prove to be a death knell to the already crumbling family system and devastating impact on the society at large,”

Same Sex Marriage Alters Social Fabric

The judges further noted that same-sex marriage was a complex issue that involved a range of legal, social, and religious considerations.

According to the Judges, “Indian cultural civilization has constantly been attacked for centuries but survived against all odds. Now in independent India it is facing attacks on its cultural roots by the superimposition of western thoughts, philosophies and practices which are not viable for this nation at all. The cancerous problems that the West is facing are sought to be imported into Bharat by vested interest groups through the misuse of judiciary as an institution in the name of right to choice.”

Imposing special cases on general conditions is a foolish idea which springs up from usually a dearth of stability. But in Indian society things have a order, and even if the order shakes there are mechanisms to bring back the order. This practical approach of Bharatiya Civilization will be changed with the borrowed social practices of the west. Therefore, all kinds of activists have to practically understand the grip of the situation without denying its consequences.

However, supporters of same-sex marriage argue that it is a matter of basic human rights and equality. They argue that the Indian Constitution guarantees equal rights to all citizens, regardless of their sexual orientation, and that denying same-sex couples the right to marry is discriminatory.
