National Conference leader Aga Syed Ruhullah Mehdi announced an impeachment motion against Justice Shekhar Kumar Yadav of the Allahabad High Court.

On Tuesday, Mehdi declared his intent to initiate impeachment proceedings under Article 124(4) of the Constitution. He accused Justice Shekhar Yadav of delivering “hate speech” at a Vishva Hindu Parishad (VHP) event. Mehdi claims support from seven opposition MPs and is lobbying Congress, Samajwadi Party, DMK, and TMC leaders to secure the required 100 signatures for his motion.

In his address, Yadav supported the UCC and stated, “The law should represent the majority to uphold secularism.”

The videos of Justice Yadav’s speech at the VHP convention are viral online. And the opposition leaders quickly labeled this as “hate speech.” But is this judicial impartiality under attack, or a targeted campaign to suppress pro-Hindu voices?

The process to impeach a sitting judge is stringent. Article 124(4) mandates “proved misbehavior or incapacity.” A motion must pass through both houses of Parliament with a two-thirds majority. And lastly, the President of Bharat must sign the impeachment passed in the Parliament. Justice Shekhar Yadav’s speech does not fulfill the criteria of “hate-specch”. Discussing the UCC at a legal seminar is far from “proven misbehavior.”

Legal experts argue that Justice Yadav’s statements align with Constitutional values.

UCC advocates gender equality, which is a fundamental right. Additionally, it allows the law to rule all citizens, irrespective of their religion. The entire movement against UCC is by the Mullah lobby. The UCC shall take away the tight-fisted rule of the Mullah in the Muslim community. Thereby, rendering them as religious heads instead of community leaders. Hence, supporting the UCC will not harm any citizens. Instead, it allows justice to be equal irrespective of religion, caste, creed, or gender to Indians. Thus, labeling his words as “hate speech” reflects the ideological desperation of INDI Alliance rather than legal merit.

INDI Alliance’s Contempt for Hindu Majority

This impeachment motion is mere optics to keep pressure on pro-UCC voices. However, it also gives a side benefit of suppressing pro-Hindu voices. The impeachment motion follows the INDI Alliance pattern of rejecting democratic mandates, powered by Hindu interests. From challenging NDA’s victories in the general election to opposing state-level pro-BJP mandates in Haryana and Maharashtra, the INDI Alliance consistently undermines the majority’s will.

Unfortunately, their contempt extends to judiciary members who speak on a positive note on UCC in Bharat. Justice Shekhar Yadav’s speech is an example of honest discourse. But instead of debate, the INDI Alliance resorts to vilification campaigns to appease its minority vote bank.

The impeachment motion against Justice Shekhar Yadav is more than an attack on one judge. It symbolizes the INDI Alliance’s intolerance for voices that speak for Bharat’s majority. Their disdain for democratic mandates, combined with their anti-Hindu rhetoric, highlights their dangerous political strategy.

The judiciary must remain independent and free to express views rooted in Constitutional principles. Impeaching a judge for advocating equality and harmony sets a dangerous precedent. It’s time Bharat’s majority recognized this war on its values and stood united against such divisive politics.
