In a recent development concerning the 2020 anti-Hindu Delhi riots, Tahir Hussain, a former AAP councillor, has been granted bail by the Delhi High Court. This comes months after a Delhi court framed murder and conspiracy charges against him. They were in connection with the killing of Intelligence Bureau official Ankit Sharma during the violent clashes. The bail was approved by Justice Anish Dayal, who presided over the single Judge Bench hearing the matter.

Conditions For Bail

While granting bail, the court imposed certain conditions on Tahir Hussain. Although he has secured bail in five cases, he will remain in judicial custody for the other charges lodged against him.

It is important to note that Tahir Hussain was also booked under the Unlawful Activities (Prevention) Act for his alleged involvement in attempting a large conspiracy during the anti-Hindu Delhi riots.

The legal proceedings against Tahir Hussain took a significant turn on March 23, when the Karkardooma court in Delhi framed murder and conspiracy charges against him, along with ten others, including Aam Aadmi Party leader Tahir Hussain. The charges filed against them include sections 147, 148, 153A, 302, 365, 120B, 149, and 188 of the Indian Penal Code (IPC). Tahir Hussain faced additional charges under IPC Sections 104, 109, and 505.

Role In The Delhi Riots

It is worth mentioning that Tahir Hussain’s alleged role in the Delhi riots has been a subject of scrutiny. Tahir Hussain had confessed in a disclosure statement. He admitted that he strategically used his house as a launching point for the riots. The fact that his house was a high-rise building under construction made it easier for him to gather stones and bricks without raising suspicion. Furthermore, he reportedly instructed his supporters to be prepared for any eventuality. He ensured that CCTV cameras in the vicinity were destroyed to prevent capturing evidence of the riots.

Blind Legalities?

With Tahir Hussain now granted bail in some of the cases against him, the legal proceedings will continue for the remaining charges. The granting of bail raises questions and has sparked debates over the handling of such sensitive cases. It also questions the pursuit of justice for the victims of the Delhi riots. As the trial progresses, the court will ultimately decide Tahir Hussain’s fate.
