As she fell to the floor, hitting her head on a table, Kumar allegedly continued his assault, kicking her in the chest, stomach, and pelvis area, causing excruciating pain.

Maliwal recounts pleading with Kumar, informing him that she was on her period and in unbearable pain, but he continued to attack her with full force. Finally, she managed to free herself and sat on the sofa, gathering her fallen spectacles. In a state of shock and trauma, Maliwal called the emergency number and reported the crime against her.

Threats and Intimidation

According to the FIR, Kumar threatened Maliwal, saying, “Do what you want, you can’t do anything. We will break all your bones and bury you in a place that no one will know about.” When he realized she had called the emergency services, he left the room.

Subsequent Events

Later, Kumar returned with security staff from the CM’s camp offices, who instructed Maliwal to leave because Kumar wanted her to. Despite informing them about the brutal assault and requesting them to wait for the police, they still made her leave. Maliwal sat on the floor outside the CM’s residence for a short time due to intense pain before eventually reaching a police station to report the matter.

Legal Implications

The authorities have filed the FIR under several sections of the Indian Penal Code, including Section 308 for attempt to commit culpable homicide, Section 341 for wrongful restraint, Section 354B for assault or use of criminal force with intent to disrobe a woman, Section 506 for criminal intimidation, and Section 509 for insulting the modesty of a woman.
